These General Terms and Conditions (GTC) govern all product sales concluded between Aquastream Hungary Kft. (referred to as the "Seller" or "Aquastream") and its clients acting as consumers or non-professionals via its website pool.aquastream.io and/or any other sales channel.
These GTC are established in accordance with applicable consumer protection regulations and form the sole basis of the commercial relationship. By placing an order, the Client fully accepts these GTC, which shall prevail over any other document issued by the Client.
TITLE I – GENERAL PROVISIONS AND PRODUCTS
Art. 1: Subject and Scope
These GTC apply without restriction or reservation to the sale of products marketed by Aquastream, including inflatable pools (specifically manufactured using high-pressure Drop-Stitch material), filtration pumps, accessories, and derived products. They are aimed exclusively at consumers.
Art. 2: Products and Duty of Information
2.1. Conformity and Standards: The products offered for sale by Aquastream comply with applicable European legislation and quality standards for domestic inflatable pools.
2.2. Detailed Description: Each product is accompanied by a detailed description (specifications, dimensions, materials, installation, and safety guidelines) to allow the Client to know the essential characteristics of the product before purchasing.
2.3. Industrial Tolerances: Slight variations in dimensions, shape, colors, or texture resulting from industrial manufacturing processes do not constitute a lack of conformity. The Client is aware of and accepts these variations.
TITLE II – CONTRACT FORMATION
Art. 3: Prices and Payment Terms
3.1. Prices: Product prices are indicated in Euros (€) including statutory value-added tax (VAT). Displayed prices do not include delivery fees, which are calculated and shown separately before the Client finalizes the order.
3.2. Deposit & Remaining Payment for Pools: For the purchase of inflatable pools, the Client pays a fixed deposit of 250 € per pool at the time of order placement. The remaining balance of the purchase price becomes due and payable when the pool is ready for shipment from our factory in Hungary. The Client will receive a payment request via email containing a secure checkout link to pay the remaining balance. If the remaining balance is not paid within 14 days of the request, the Seller reserves the right to cancel the order and refund the deposit in full.
3.3. Order Confirmation: The order is finalized and becomes binding once the Client completes the checkout and payment process of the deposit (or the full price for non-pool products). Confirmation is sent immediately via email.
3.4. Proof of Transaction: Data recorded by Aquastream constitutes proof of all transactions between the Seller and the Client.
3.5. Payment Methods: Accepted payment methods for both deposits and remaining balances include credit cards (Visa, MasterCard), bank transfers, and other integrated payment service providers.
TITLE III – CONTRACT PERFORMANCE
Art. 4: Shipping and Delivery
4.1. Delays and Terms: Delivery timeframes are communicated during checkout. Because shipments are fulfilled from a limited campaign allocation, delivery delays may occur in exceptional circumstances.
4.2. Transfer of Risk: The transfer of risk for loss or damage to the goods occurs when the Client (or a designated third party) takes physical possession of the products.
4.3. Inspection upon Receipt: The Client must inspect the package and products upon delivery. Any damage, missing items, or defects must be noted in writing on the carrier's delivery slip and reported to Aquastream within 48 hours, along with photographic evidence.
Art. 5: Right of Withdrawal (Cancellation Policy)
5.1. Period: Consumers have a statutory right to withdraw from the contract within 14 calendar days from the day they (or a designated third party) receive the product, without giving reasons.
5.2. Returns and Costs: The Client must notify Aquastream of their decision through an unequivocal statement (e.g. email). Products must be returned in brand new, complete condition and in their original packaging within 14 days of the notice. The direct cost of returning the goods is borne entirely by the Client.
5.3. Legal Exclusions: The right of withdrawal is excluded for goods that have been unsealed after delivery and cannot be returned for hygiene or health protection reasons, or goods that by their nature are irreversibly altered after use.
*Special clause for Inflatable Pools:* Any inflatable pool that has been inflated, filled with water, or used is strictly excluded from return, as it is impossible to resell it as new for hygiene reasons.
5.4. Refund: Aquastream will refund all payments received from the Client (excluding initial delivery fees) within 14 days of receiving the returned products.
TITLE IV – WARRANTIES
Aquastream guarantees that the sold products are compliant with regulations and free from manufacturing defects at the time of delivery.
6.1. Statutory Warranty: The Client is entitled to the legal warranty of conformity within statutory periods (2 years from delivery). The Client may choose repair or replacement, unless the chosen option is impossible or entails disproportionate costs.
6.2. Exclusions from Warranty: The warranty does not cover damages resulting from:
- Incorrect use or installation (e.g. punctures, cuts, abrasions, overpressure, creases due to incorrect storage);
- Environmental factors (e.g. extreme heat, storms, frost, lightning);
- Lack of maintenance (e.g. incorrect pH value outside the 7.0–7.6 range, failure of daily filtration, or improper winter storage);
- Normal wear and tear;
- Commercial or non-domestic use.
TITLE V – LIABILITY AND DISPUTES
Art. 7: Liability
Aquastream is not liable for damages resulting from client negligence, failure to follow installation, usage, maintenance, or safety guidelines (including the requirement for continuous adult supervision of children), or events of force majeure. To the extent permitted by law, civil liability is limited to the purchase price of the product.
Art. 8: Safety and Use
The pool must be set up on a flat, clean, and smooth surface. The Client is solely responsible for the close, continuous supervision of children in and around the pool. Diving into inflatable pools is strictly prohibited.
Art. 9: Data Protection (GDPR)
Aquastream processes personal data of the Client in compliance with the General Data Protection Regulation (GDPR) solely for contract execution and customer service. Data is not sold or shared with unauthorized third parties.
Art. 10: Force Majeure
Aquastream is not liable for failure to perform its obligations due to events of force majeure (e.g. strikes, logistics disruptions, extreme weather, pandemics, cyberattacks, material shortages).
Art. 11: Applicable Law and Dispute Resolution
11.1. Online Dispute Resolution (ODR): The European Commission provides a platform for online dispute resolution, available at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11.2. Applicable Law: The contract and these GTC are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), without prejudice to mandatory consumer protection laws of the Client's country of residence.
